This Privacy Policy Regarding Personal Data (hereinafter — the “Privacy Policy”) covers all information which can be obtained by the website Vintage Photo Studio located at the domain name https://retrofotostudio.ru and subdomain https://eng.retrofotostudio.ru during the User’s using the website, its programs and products.

1. DEFINITIONS

1.1. This Privacy Policy uses the following definitions:

1.1.1. The Vintage Photo Studio Website Administration (hereinafter — the “Website Administration”) are the employees authorized to manage the website acting on the behalf of the Vintage Photo Studio who organize and/or perform the personal data processing, as well as define the reasons of personal data processing, components of the personal data subject to processing, actions/operations applied to personal data.

1.1.2. Personal Data is any data related directly or indirectly to a specific or defined individual (subject of the personal data).

1.1.3. Personal Data Processing is any action/operation or a range of actions/operations applied with means of automation or without such means to the personal data including collecting, recording, systematizing, consolidating, storing, refining (updating, changing), extracting, using, transferring (disseminating, presenting, accessing), depersonalizing, banning, deleting, destroying personal data.

1.1.4. Personal Data Privacy is a mandatory requirement for any Operator or other persons who have access to personal data to avoid their dissemination without the subject’s consent or a lawful excuse.

1.1.5. Vintage Photo Studio Website User (hereinafter — the “User”) is a person accessing the Website via Internet and using the Website.

1.1.6. Cookies are a fracture of the data sent by the web service and stored on the user’s computer which is transferred by the web client or web browser to the web server each time in a HTTP request when the user attempts to open a page of the corresponding website.

1.1.7. IP address is a unique web address of the network nodes built under the IP protocol.

2. GENERAL

2.1. The Website User’s using this website means that they agree with this Privacy Policy and conditions of the User’s personal data processing.

2.2. If the User does not agree with the provisions of the Privacy Policy, the User shall stop using the Vintage Photo Studio website.

2.3. This Privacy Policy applies only to the Vintage Photo Studio Website. The website does not control or is not responsible for websites of third parties which the User can find through links available on the website.

2.4. The Website Administration does not check the validity of the personal data provided by the User of the website.

3. SUBJECT OF THE PRIVACY POLICY

3.2. Personal data allowed to processing under this Privacy Policy are provided by the User by their filling the registration form on the Vintage Photo Studio Website and/or form of communication, and include the following information:

4. GOALS OF THE USER’S PERSONAL DATA COLLECTION

4.1. The Website Administration can use the User’s Personal Data for achieving the following goals:

4.1.1. Identification of the User who has booked a visit

4.1.2. Providing the User with access to the personalized resources of the Website.

4.1.3. Communicating with the User, including sending notifications, requests regarding the use of the Website, providing services, processing requests and applications from the User.

4.1.4. Validation and verification of the personal data provided by the User.

4.1.5. Notifying the Website User about the offers and confirmation of booking.

4.1.6. Advertising activities with the User’s consent.

5. MEANS AND TERMS OF PERSONAL DATA PROCESSING

5.1. User’s personal data processing is performed for an unlimited period of time, by any legal means including that in informational systems of personal data with the use of automation means or without the use of such means.

5.2. The User agrees that the Website Administration has the right to transfer the personal data to third parties, in particular, to the hospital dispatch services only for the purpose of the User’s booking realization

5.3. User’s personal data can be transferred to the authorized bodies of the Russian Federation government under the excuse or in the order stipulated by the legislation of the Russian Federation.

5.4. If the personal data are lost or disclosed, the Website Administration informs the User about the loss or disclosure of the personal data.

5.5. The Website Administration takes the necessary organizational and technical measures for the User’s personal data protection from unauthorized or accidental access, deleting, changing, banning, copying, disseminating as well as unauthorized actions of third parties.

5.6. The Website Administration and the User collectively take the necessary measures to avoid losses or other negative consequences implied by the loss or disclosure of the User’s personal data.

6. OBLIGATIONS OF THE PARTIES

6.1. The User is obliged:

6.1.1. To provide the information on the personal data necessary to use the Website.

6.1.2. To update or complete the provided information on the personal data in case of changes in such information.

6.2. The Website Administration is obliged:

6.2.1. To use the provided information solely for the purposes stipulated in paragraph 4 of this Privacy Policy.

6.2.2. To secure the confidential information, not to disclose it without the User’s prior consent, as well as not to perform trade, exchange, publishing or disclosure by any other means of the User’s provided personal data except for the subparagraphs 5.2. and 5.3. of this Privacy Policy.

6.2.3. To take preventive measures to protect the privacy of the User’s personal data according to the procedure traditionally used to protect such information in the existing business practice.

6.2.4. To perform banning of the personal data related to a certain User, from the moment of the application or the request of the User or their lawful representative or an authorized body for the protection of the rights of the personal data subject for the period of the validation, in case of finding invalid personal data or unauthorized actions.

7. LIABILITIES OF THE PARTY

7.1. The Website Administration who does not fulfil its obligations is responsible for the losses experienced by the User in relation to the unauthorized use of the personal data in compliance with the Russian legislation except for the cases stipulated by subparagraphs 5.2., 5.3. and 7.2 of this Privacy Policy.

7.2. In case of loss or disclosure of the confidential information the Website Administration is not responsible if such confidential information:

7.2.1. Became public prior to its loss or disclosure.

7.2.2. Was obtained from a third party prior to its provision to the Website Administration.

7.2.3. Was disclosed with the User’s consent.

8. SETTLEMENT OF DISPUTES

8.1. Prior to legal action with a claim arising from the relationship between the Website User and the Website Administration, it is obligatory to present the claim (written proposal of voluntary settlement).

8.2. The claimee shall notify the claimer within 30 calendar days from the date of getting the claim about the results of the consideration of the claim in a written form.

8.3. If the agreement is not reached, the claim will be submitted to the court in compliance with the effective legislation of the Russian Federation.

8.4. The effective legislation of the Russian Federation is applied to this Privacy Policy and the relationship between the User and the Website Administration.

9. OTHER

9.1. The Website Administration has a right to change this Privacy Policy without the User’s consent.

9.2. New Privacy Policy comes into effect from the moment it is placed on the Website, if not stated otherwise by the new version of the Privacy Policy.
